Terms of Service for MahJong Now

Nature of the Service

MahJong Now is a casual board game provided purely for entertainment. The App does not offer real-money gambling and provides no opportunity to win money or physical prizes.

Scores are expressed in tai (台), the traditional Taiwanese scoring unit. Tai has no cash value: it cannot be bought, sold, redeemed, transferred, or exchanged for currency or anything else of value. The App contains no chips, no stakes, no wagering, and no currency of any kind, and nothing in it can be purchased.

You must not use the Service as an instrument for gambling between players, including by agreeing to settle results with money or anything of value outside the App. We have no visibility into any such arrangement and accept no responsibility for it; it is made at your own risk and in breach of these Terms.

1. Acceptance of Terms

By downloading, installing, or using MahJong Now ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must discontinue use of the Service.

1.1 Platform Terms

If you download or use the Service through the Apple App Store, your use of the Service is also subject to the Apple Standard End User License Agreement (EULA). In the event of any conflict between the Apple EULA and these Terms, the Apple EULA shall prevail solely to the extent required by Apple's platform policies. For all other matters, these Terms shall apply.

2. Eligibility

• You may use the Service only if you are legally permitted to do so under the laws of your jurisdiction.
• No account registration is required to use the App, including for online play.

3. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes.
• Infringe upon the rights of others, or break laws relating to privacy, copyright, or trademarks.
• Choose a nickname that is offensive, harassing, obscene, impersonates another person, or infringes the rights of others.
• Harass, abuse, or deliberately disrupt the games of other players.
• Use a modified client, automated player, or any other means of gaining an unfair advantage in online play.
• Interfere with, overload, or attempt to gain unauthorised access to the relay server or any other part of the Service.
• Reverse engineer, decompile, or attempt to extract source code from any proprietary or separately licensed portions of the Service, except where such activity is permitted by applicable law or by an applicable open-source license.
• Distribute malware, spam, or harmful content.
• Use automated tools (bots, scrapers) to access or extract data from the Service.
• Reproduce, resell, or exploit the Service for commercial purposes, or attempt to build a competing product using the Service.
• Impersonate others or engage in fraudulent behaviour.

Violation of these rules may result in suspension or termination of your access to the Service.

4. User Content

• Your game records, statistics, and settings are stored locally on your device. The App does not upload them.
• The only content you supply that other people see is the nickname you choose, which is shown to the other players in a room you are in. You are responsible for it, and section 3 applies to it.
• Online rooms are private: a player can only join a room if they have been given its room code. There is no public matchmaking with strangers.
• If you encounter an offensive nickname or abusive behaviour, leave the room and, if you wish to report it, contact support@myopen.app.
• If you contact support by email, any information you provide is voluntary.

5. Online Play & Service Availability

Online play depends on a relay server that we operate and provide free of charge and on a best-effort basis.

• We do not guarantee that the relay will be available, reachable, or free of interruption.
• Games in progress may be interrupted by network conditions, server restarts, or maintenance.
• Room data exists only in memory for the life of the room. A game that is interrupted may not be recoverable, and we do not undertake to restore it.
• We may change, limit, or discontinue online play at any time, including in order to control operating costs.

Single-player games against the built-in AI do not depend on the relay and continue to work without a network connection.

6. Advertising

The Service is supported by advertising supplied by Google AdMob. By using the Service you accept that ads will be displayed. You must not interfere with, obscure, or attempt to circumvent the display of ads, or generate invalid ad activity.

7. Purchases

The current version of the Service contains no in-app purchases and no subscriptions. Future versions may introduce optional paid features; playing mahjong itself will remain free. If paid features are introduced in a future version, they will be sold through the platform's own purchase system, and the platform's refund policy will apply. These Terms will be updated accordingly.

8. Disclaimer

The Service is provided "AS IS" and "AS AVAILABLE," without warranty of any kind.

Specifically, no guarantees are made regarding:

• uninterrupted operation
• error‑free performance
• availability of the relay server or completion of any online game
• accuracy, reliability, or completeness of displayed information, including score calculation
• security of the Service
• preservation or persistence of locally stored data

The App stores your game data locally on your device; you are solely responsible for your own device backups. Your use of the Service is at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, the Provider shall not be liable for any indirect, incidental, or consequential damages, including but not limited to:

• loss or corruption of data, including game records and statistics
• interrupted or unrecoverable online games
• service interruptions and technical errors
• hardware damage

9.1 Maximum Liability

To the extent permitted by law, the total liability of the Provider for any claim shall not exceed:

• the amount you paid for the Service in the past 12 months, or
• USD $10 if no payment was made.

10. Force Majeure

The Provider is not responsible for delays or failures caused by events beyond reasonable control, including:

• outages of Apple, Google, or our hosting provider
• system failures and network disruptions
• natural disasters, war, terrorism, government restrictions, epidemics
• internet or power failures
• changes in platform policies
• third-party service failures

These events may affect the availability, functionality, or performance of the Service, and the Provider shall not be held liable for any resulting impact.

11. Changes & Termination

The Provider reserves the right to update, modify, suspend, or discontinue the Service (or any part of it) at any time, for any reason, with or without notice. You agree that the Provider shall not be liable to you or any third party for any such change. Features may change or be removed due to technical, business, or platform requirements.

11.1 Effect of Changes to Terms

The Provider may update these Terms from time to time. Continued use of the Service after updated Terms become effective constitutes your acceptance of the revised Terms.

11.2 Termination

If you violate these Terms, the Provider may restrict, suspend, or terminate your access to the Service immediately, without prior notice. The Provider is not responsible for any loss of data or functionality resulting from such termination.

12. Governing Law & Jurisdiction

These Terms are governed by the laws of Taiwan (Republic of China). Any disputes shall be resolved by the Taipei District Court.

13. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.

14. Entire Agreement

These Terms, together with any applicable platform terms (including the Apple Standard EULA where applicable), constitute the entire agreement between you and the Provider regarding the Service and supersede any prior communications or understandings.
